1. Acceptance of Terms

By accessing or using OSBeats, you agree to these Terms of Service and all policies incorporated into these Terms, including the Acceptable Use Policy, Content Policy, DMCA/Copyright Policy, Privacy Policy, and Refund Policy.

2. OSBeats Marketplace

OSBeats is an independent music marketplace that enables artists and producers to upload and offer original or properly authorized music, beats, licenses, and related digital content. Users may discover music, purchase eligible digital content, and license music directly from creators.

3. Accounts and Platform Access

Users are responsible for providing accurate account information, maintaining the security of their login credentials, and all activity performed through their accounts. OSBeats may restrict, suspend, or deactivate accounts that violate platform rules or create security, fraud, payment, or legal risk.

4. Creator Content and Ownership

Creators retain ownership of content they lawfully upload. By uploading content, creators grant OSBeats the limited rights necessary to host, display, stream, promote, index, moderate, and make that content available through the platform.

Creators must own or possess all rights and permissions necessary to upload, distribute, sell, and license their content.

5. Prohibited Content and Activity

OSBeats does not permit users to upload, sell, monetize, distribute, promote, or otherwise use the platform for prohibited content or activity.

Prohibited content includes pornography; nudity or sexually explicit content intended for sexual gratification; adult live-chat or adult entertainment services; prostitution, escort, or sexual services; fetish content; sexually explicit AI-generated content; child sexual abuse material; stolen or copyright-infringing material; unauthorized music or artwork; violent extremist or terrorist content; unlawful hate-based content; malicious content; fraud; scams; payment manipulation; or other unlawful content or activity.

OSBeats also prohibits harassment, threats, impersonation, coordinated abuse, artificial manipulation of plays, downloads, rankings, reviews, followers, or marketplace visibility, and attempts to bypass platform security or moderation systems.

6. Marketplace Transactions

Beat licenses, direct purchases, bundles, memberships, and paid promotions may have different terms and prices. Buyers are responsible for reviewing the applicable license and purchase terms before completing a transaction. Creators are responsible for accurately describing the rights and products being offered.

7. Digital Delivery and Licensing

Purchased digital content may be delivered electronically following successful payment. Access to purchased content remains subject to the applicable license or purchase terms.

Music offered through OSBeats may be available under Standard, Premium, Exclusive, Buy Now, or other creator-provided licensing options. The rights granted to a buyer are determined by the applicable license.

8. Content Reporting and Moderation

OSBeats provides reporting functionality that allows users and other affected parties to report content or accounts believed to violate OSBeats policies or applicable rights.

OSBeats may review reported or detected content, preserve moderation records, request additional information, restrict marketplace functionality, hide or remove content, suspend monetization or selling privileges, suspend or deactivate accounts, and escalate matters for further review when appropriate.

9. Copyright and Repeat Violations

OSBeats prohibits copyright infringement and unauthorized distribution of protected material. Rights holders may report allegedly infringing content through OSBeats' reporting procedures and DMCA/Copyright process.

OSBeats maintains a policy addressing repeat or serious violations. Accounts associated with repeated copyright infringement, prohibited content, fraud, or other serious or repeated policy violations may have content removed, marketplace privileges restricted, or accounts suspended or terminated.

10. Refunds

Refunds and transaction disputes are handled according to the OSBeats Refund Policy. Because digital products may be delivered immediately, completed purchases may be final except where required by law, where a transaction qualifies for correction, or as otherwise provided by the applicable Refund Policy.

11. Enforcement

OSBeats may take reasonable action to protect users, creators, payment partners, rights holders, and the marketplace. Enforcement may include warnings, content removal, demonetization, feature restrictions, transaction review, account suspension, or account termination depending on the circumstances.

12. Availability

OSBeats may modify, suspend, or discontinue platform features as the service develops. OSBeats does not guarantee uninterrupted availability.

13. Limitation of Liability

To the extent permitted by applicable law, OSBeats is not responsible for indirect or consequential losses arising from use of the service, creator-to-buyer disputes, unauthorized seller content, misuse of purchased content, or third-party services.

14. Changes to These Terms

OSBeats may update these Terms as the marketplace, legal requirements, payment requirements, or platform features evolve. Material changes may be communicated through the website or account notices.
